User Agreement
1. Definitions
Service/Widget — the “TLST Comments” widget enabling comments on third‑party websites.
Site Administrator — an entity embedding the Widget and defining auth/moderation rules.
User — a person posting comments via the Widget.
2. Acceptance
By using the Widget (including authentication and posting) you accept these Terms. Certain features require separate PD consent.
3. Registration & Access
- Auth methods may include e‑mail/password and social sign‑ins (e.g., VK, Facebook, Google, OK, Telegram, X, Yandex, GitHub, Discord, Reddit, Mail.ru, Dropbox, LinkedIn, Twitch, T‑bank, Dribbble, Microsoft, TikTok, WordPress, Battle.net). The specific methods are set by the Site Administrator.
- Guest/anonymous commenting may be allowed by the Site Administrator.
- Users are responsible for secrecy of their credentials and legality of their content.
- Site Administrators are solely responsible for their auth choices, moderation, age compliance and local legal requirements on their websites.
4. User Content
- Users retain rights to their content.
- The User grants TLST Comments a non‑exclusive, royalty‑free license to reproduce, make available, publicly display, technically process (incl. formatting/machine translation), store and sublicense to Site Administrators strictly to operate the Service.
- No transfer of exclusive rights.
5. Prohibited Content & Moderation
- Content prohibited under Russian law must not be posted (e.g., extremism; promotion of drugs/suicide; CSAM; disclosure of secrets; third‑party PD without legal basis).
- Moderation may be pre‑, post‑ or combined and can include automated filters/ML at the Site Administrator’s discretion.
- TLST Comments may remove/limit access upon obvious violations, lawful requests or to prevent harm.
- Site Administrators must maintain functional moderation, promptly act on complaints and prevent prohibited content.
- For obvious violations, Site Administrators must remove/hide infringing content within 72 hours upon notice from a User, a Rightsholder or TLST Comments.
- Site Administrators must not intercept or reuse social‑login tokens or other auth data outside the Widget mechanisms.
- Site Administrators are liable for claims relating to content on their sites (illegal information, IP violations, advertising/labeling requirements), except where caused by the Service itself.
- Site Administrators indemnify TLST Comments for losses caused by their breaches, including government fines and rightsholder claims (limited to actual losses).
6. Notice‑and‑Takedown
Rightsholders may notify help@tolstoycomments.com with: (a) name/contacts; (b) work and rights; (c) exact URLs; (d) grounds for infringement; (e) proof of rights. TLST Comments will act upon sufficient information. Users may submit counter‑notifications.
6.1. Site Administrators must maintain a valid abuse address and, upon notice from TLST Comments, act within the 72‑hour window or provide a reasoned response.
7. Notifications
Service e‑mails (e.g., reply/mention) may be sent with an opt‑out option.
8. Liability
TLST Comments acts as an information intermediary, does not initiate posting or select recipients, and removes/limits access upon notice. Liability is limited to direct proven damages.
9. Law & Venue
Governing law: Russia. Mandatory pre‑trial claim period: 30 days. Venue: courts at the Operator’s place of registration.
10. Changes
Changes take effect upon publication at https://tolstoycomments.com/en/legal/terms/. Material changes to PD purposes require renewed consent.
